BildDas Cologne Higher Regional Court judge has just (re: 9 U
pronounced 188/07), in which an owner of the stolen motorcycle for a
test ride motorcycle replaced by his insurance company receives.
The prospective buyer disappeared in a motorcycle test drive - without
showing his identity card. But he had not received any registration
papers. Only the old car was left behind - acquired as a hobbyist
vehicle and not re-registered. Thus, the thief could not be traced.
The insurance of the injured reported that the owner was the victim of
fraud. In addition, he acted with gross negligence, because he took no
personal details. But: The court ruled for the injured, he will receive
£ 10,650 from the third party insurance.
Because: It was a "diversion" - the ride was not light stuff and passing the test drive was agreed only in a small town.
And: The seller would have in an emergency the owner can find out about the features of the abandoned car.
